What should I do if I am arrested?
State that you want a lawyer and say nothing else — politely, but nothing. You have the right to an interpreter and to know the accusation. The statement can wait until counsel is beside you; that is the law working as designed.
Can I use my own lawyer instead of the duty one?
Yes, at any moment — including at the police station before a statement. If we take over an ongoing case, the file transfers and the defence continues without a gap; what was already declared stands, though — another reason to call early.
Do I have to be in Spain for the whole procedure?
Not always. Many phases can be handled through your lawyer with a power of attorney, and for some hearings video appearance is possible. We tell you exactly which dates truly require you.
What if I am the victim?
Spain lets victims prosecute alongside the public prosecutor — with your own lawyer arguing for conviction and compensation. For fraud and theft it is often the most direct road to actually recovering something.
